Our April 13, 2012, blog post discussed the March 9, 2012, Chapter 11 bankruptcy petition filed by the Western Mohegan Tribe and Nation of New York, Case No. 12-09292, United States Bankruptcy Court for the Northern District of Illinois, Eastern Division. The filing, and a motion to dismiss, raised the issue whether a recognized tribe could seek relief under Chapter 11 and, potentially, the effect of the Indian Gaming Regulatory Act, 25 U.S.C. § 2701 et seq., on a filing by a tribe operating a casino. read more

In a much anticipated ruling, today the Supreme Court affirmed the D.C. Circuit's decision in Match-E-Be-Nash-She-Wish Band of Pottawatomi Indians v. Patchak et al.. Contrary to years of precedent, the Court held in an 8-1 opinion that the Quiet Title Act's "Indian lands exception" does not bar suits against the United States to challenge title to land held in trust on behalf of an Indian tribe. read more
